PRESS RELEASE

     Sussex County Prosecutor Francis A. Koch announced the entry of a guilty plea to an accusation before the Honorable Michael C. Gaus, J.S.C. at the Sussex County Courthouse in Newton on June 27, 2022 by Jake R. Diebner.

     Diebner, age 31, of Riverdale, pled guilty to Theft by Failure to Make Required Disposition of Property Received, a crime of the third degree.  Sentencing is presently scheduled for September 1, 2022 before the Honorable Michael C. Gaus, J.S.C.                          

     In pleading guilty, the defendant admitted to taking funds allocated for a swimming pool that he was contracted to build along with his company, and utilized the funds for other things. The amount taken was more than $500.00 and less than $75,000.00.

     Diebner was represented by Lawrence H. Kleiner, Esq., and the State was represented by Assistant Prosecutor Brent M. Rafuse.
