Sussex County Prosecutor Francis A. Koch announced the sentencing of Mark W. DiBattista, who appeared before the Honorable Michael Hubner, J.S.C. via the Sussex County Courthouse in Newton on June 17, 2020.
DiBattista, age 62, of Branchville, was sentenced to 180 days in the county jail and he must successfully enter and complete the Drug Court Program. He must also pay $1023.45 restitution to the victim and court fines and fees.
He pled guilty on May 4, 2020, to Assault by Auto, a crime of the third degree and pled to motor vehicle violation Driving While Intoxicated June 17, 2020.
The defendant was intoxicated while operating his motor vehicle and struck a pedestrian outside the Hampton Walmart causing multiple injuries.
DiBattista was represented by David H. Dumbroff, Esq. and the State was represented by Assistant Prosecutor Brent M. Rafuse.
