Press Release - Plea of Mark W. DiBattista

Sussex County Prosecutor Francis A. Koch announced the entry of a guilty plea to an indictment before the Honorable Louis S. Sceusi, J.S.C., via the Sussex County Courthouse in Newton on May 4, 2020 by Mark W. DiBattista.
DiBattista, 62, of Branchville, pled guilty to Assault by Auto, a crime of the third degree. Sentencing is presently anticipated for Wednesday June 17, 2020 before Judge Michael Hubner, J.S.C.
In pleading guilty, the defendant to be intoxicated while operating his motor vehicle and striking a pedestrian outside the Hampton Walmart causing multiple injuries.
The case was investigated by Trooper Pall of the New Jersey State Police.
DiBattista was represented by David Dumbroff, Esq., and the State was represented by Assistant Prosecutor Brent M. Rafuse.
