Sussex County Prosecutor Francis A. Koch announced the entry of a guilty plea to an indictment before the Honorable William J. McGovern III, J.S.C., at the Sussex County Courthouse in Newton on December 5, 2016, by Kurt Takach.
Takach, age 49 of Montague, pled guilty to Aggravated Assault, a third degree crime, Resisting Arrest, a third degree crime, and Leaving the Scene of an Accident, Reckless Driving, and Refusal to Take a Breath Test, all motor vehicle offenses. Sentencing is presently anticipated for January 27, 2017.
In pleading guilty, the defendant admitted to leaving the scene of a motor vehicle accident on January 24, 2015, in Montague Township. The defendant admitted that upon being located by a New Jersey State Police Trooper that he caused bodily injury to the trooper by pushing a car door shut on the trooper’s leg and then causing further risk of injury by physically resisting arrest.
The case was investigated by Trooper Dominic Rubino of the New Jersey State Police. Takach was represented by Martin Morrison, Esq., and the State was represented by Assistant Prosecutor Donald F. Cox, Jr.
