Sussex County Prosecutor Francis A. Koch announced that the Sussex County Grand Jury handed up an Indictment to the Honorable William J. McGovern, III, JSC at the courthouse in Newton on May 26, 2016 against Steven Smith, Edward Bochinsky, Jr. and Theodore Robbins II.
The Indictment charges Edward Bochinsky, Jr., age 32, of Sussex Borough, New Jersey and Steven Smith, age 29 of Sussex Borough, New Jersey each with 1 count of 1st degree Strict Liability For a Drug Induced Death, 1 count of 3rd degree Distribution of Heroin and 1 count of 3rd degree Conspiracy to Distribute Heroin. It is alleged that both defendants distributed a controlled dangerous substance to B.A. age 22 in the Township of Wantage on August 21, 2015 and that B.A. then died as a result of the injection of that controlled dangerous substance. The defendants are currently lodged in the Keogh Dwyer Correctional Facility in lieu of the bail established by the Superior Court.
The Indictment also charges Smith with Distribution, Possession with Intent to Distribute and Possession of a controlled dangerous substance on August 24, 2015 in the Township of Newton, County of Sussex.
The Indictment also charges Smith and Theodore Robbins, II with Possession with Intent to Distribute and Possession of a controlled dangerous substance on October 2, 2015 in the Township of Lafayette, County of Sussex.
This matter was investigated by The Sussex County Prosecutor’s Office and The New Jersey State Police.
The case was presented to the Grand Jury by Assistant Prosecutor Seana Pappas. Arraignment before the Superior Court in Newton will be within the next 6 weeks.
A Grand Jury indictment is a charge only. The defendant is presumed innocent until guilt may be proved at a jury trial.
